Acceptance of These Terms By accessing or using the website located at https://clearottawa.com (the “Site”) or by scheduling, purchasing, or otherwise using any services offered by Clear Ottawa Windows (“Clear Ottawa,” “we,” “our,” or “us”), you (“you” or “Customer”) agree to be bound by these Terms of Service (the “Terms”). If you do not accept these Terms, do not use the Site or our services.

Scope of Services Clear Ottawa provides exterior and interior window cleaning, gutter cleaning, repair, and installation services (collectively, the “Services”). Details, pricing, and availability of specific Services may vary by location and are subject to change without notice. All quotes are estimates only until confirmed following an on-site or satellite (e.g., Google Maps) inspection.

Quotes & Estimates

• Requesting a Quote – Customers may request an estimate online, by phone, or via SMS. You agree to provide accurate information, including service address and service history, to facilitate an accurate quote.
• Accuracy – Quotes are based on the information you provide, satellite imagery, and/or previous service records. Final pricing may change upon physical inspection. We will notify you of any price adjustments before work begins.

Scheduling, Rescheduling & Cancellation

• Scheduling – Appointments are reserved on a first-come, first-served basis following quote acceptance. You will receive confirmation of the date and an approximate arrival window.
• Rescheduling – To reschedule, contact us at least 24 hours in advance. We will make reasonable efforts to accommodate your requested date.
• Cancellation – Cancellations made less than 24 hours before the scheduled appointment may be subject to a cancellation fee of up to 20% of the quoted price, at our discretion.

Customer Responsibilities

Provide safe and unobstructed access to the property, including windows, gutters, and water spigots.

Secure pets and remove or cover fragile items near work areas.

Inform our technicians of any known hazards (e.g., loose siding, wiring) prior to service.

Payments

• Due Date – Payment is due in full upon completion of Services unless otherwise agreed in writing.
• Accepted Methods – We accept major credit cards, e-transfers, and checks payable to “Clear Ottawa Windows.” A $30 fee applies to returned checks.
• Late Payments – Outstanding balances accrue interest at 1.5% per month (18% per annum) commencing 15 days after the invoice date.

Limited Warranty & Service Issues

• Workmanship Guarantee – We warrant our workmanship for 7 days after service completion. Report any concerns to us within this period for a complimentary touch-up.
• Exclusions – We do not guarantee against future environmental factors (e.g., pollen, weather) or pre-existing damage.

Intellectual Property

All content on the Site—including text, graphics, logos, and software—is the property of Clear Ottawa or its licensors and is protected by Canadian and international intellectual-property laws. Unauthorized use is prohibited.

User Conduct

You agree not to:

• Use the Site or Services for any unlawful purpose.
• Attempt to interfere with the Site’s operation or security.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Third-Party Links

The Site may contain links to third-party websites. Clear Ottawa is not responsible for the content or privacy practices of such sites. Access them at your own risk.

Privacy

Our collection, use, and disclosure of your information are governed by our Privacy Policy (last updated June 4, 2018). By using the Site or Services, you consent to such processing and warrant that all data provided is accurate.

Limitation of Liability

To the fullest extent permitted by law, Clear Ottawa, its officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Services or these Terms, even if advised of the possibility of such damages. Our total liability in any matter arising out of or related to the Services is limited to the amount you paid for the specific Service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Clear Ottawa and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or Services, breach of these Terms, or violation of any applicable law.

Modifications

We may modify these Terms at any time. Updated Terms will be posted on the Site with a new “Last Updated” date. Continued use of the Site or Services after any such changes constitutes your acceptance of the revised Terms.

Governing Law & Dispute Resolution

These Terms and any dispute arising hereunder are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Ottawa, Ontario.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with any written quote or work order, constitute the entire agreement between you and Clear Ottawa regarding the Services and supersede all prior or contemporaneous communications.
